Meeting called to order at 9:00 a.m.

Minutes of the December 15th. 2006 meeting approved.

Homeowners’ comments regarding specific issues: 

A letter submitted by Judy McCay to the SBCA ARC was read aloud with points of clarification being made throughout. There were 6 key issues addressed in the letter covering topics such as slope stability, trees cut rather than topped or limbed other than stated in the original permit application, the view creation versus view maintenance topic, concern that if this a stage one of three parts, then let’s review what trees are going to be addressed. She gave a copy to each member of the SBCA ARC, also including photographs of the result thus far, as well as a map outlining common area and trails area, including the proposed areas yet to be addressed.

Larry Elton spoke of trees in the Woodridge common area, as well as alders on Teal Lake Road that after having been topped, are now dead, and it has been requested that they be removed. He is unsure as to whether this is Olympic Terrace 2 property, but he will get the noted trees marked and then take the matter to his HOA on January 25th area before submitting a permit application to the SBCA ARC.

Updates                                              06-139Windrose group- Bayview tree cutting

                                                            Discussion ensued centering on any more possible requests of cut trees, ribbons are on some trees but the SBCA ARC has not yet been approached for a another permit application from Bayview Village. It was determined that the whole community should have input before a permit comes to the SBCA ARC in order to prevent a misperception on the part of some homeowners as to whether the permit had been modified, altered, etc. The diesel fuel spill was addressed, and the SBCA ARC has been reassured that the EPA gave clearance to T. Oswald for the work that had been done. R.Head asked for documentation to that effect. Re the pile of wood chips: they were the result of the Bayview cleanup and those chips have been given to the Trails/Natural Resources committee to handle. A rapid cleanup is recommended. J. McCay questioned whether in fact a village rep was on site when the trees were cut, and when the permit modifications were altered from the original request. A. Andersen pointed out that not only were the trees involved with Bayview Village, but some other trees fell as a result of the wind storm or as a result of the actions of Jefferson County, and that some of the cleanup problems are attributable to those other sources. It is the SBCA ARC’s belief that Jefferson County assured them that slope stability was not a concern with the trees that had been marked for removal. R.Head stated that he felt there are two matters of concern: 1. that the problem be rectified immediately, 2. If the permit application is changed or modified by the SBCA ARC, then the entire permit should revert back to the HOA in order for all owners to be fully informed. The SBCA ARC and Board do not officially recognize “enhancements”, and a suggestion was made that at the upcoming Village Presidents’ Meeting on January 26 that the Board should try to remove” and enhance” Design Standards, since to remove from the CC & R’s would prove to be very difficult.

R.Kraft provided some insight from LPV-4 that has already established that any common area adjustments (e.g. trees) require a super majority of the village by secret ballot.  B.Stoner also recommended that photos be included in permit application to more fully explain the situation in point. It was mentioned that where trees are involved on slopes, that both an arborist and a geotech should give their input. B.Pardis queried the control of the SBCA ARC when unwanted or unpermitted actions take place. A. Andersen explained the appeals process used when the SBCA ARC and the Village ARC cannot agree that the matter goes to the SBCA Board. He reiterated that the Trails issue and County land in some “mixed common areas” and the input of neighboring villages are all mitigating factors.

The members of the SBCA ARC stated they will strive to be through and diligent re any common area concerns and ensure that those concerns are sent back to the Village for village approval.

New Business:                                  

ARC Chairman - Rotation of Chairman

It has been decided that the chair of the ARC committee should be a voting member of the SBCA. All SBCA ARC members recognized the diligent, hard work and support that Linda Colasurdo has provided in her capacity as Manager of the committee over the past few months and she will continue in that position.

MSP that a rotational chair be appointed on a one-year basis. (all ayes)

MSP that Jerry Perlot be appointed for the first calendar year.  (all ayes)

In his absence his designate will chair. In subsequent years, the position will rotate through the other members of the SBCA ARC, and be appointed for a one calendar year term.                                                                               

Review Circulation Notice for Village ARC intake

A new Village ARC circulation notice in the color blue has been made to ensure easier awareness of type of permit application.

There is now a place for ARC members to indicate that they have read the application (this may be done before the meeting), and another to indicate that they approve, conditionally approve or deny permit application and is to be filled out at the SBCA ARC meeting only.

Working board meeting in February:

A date is to be determined by mutual consent, prior to the Village Presidents’ meeting on January 26th. 2007. Agenda items: the response to the McCay letter; altering Village ARC responsibilities re common areas.  All members will receive a copy of the original permit issued to the Bayview group, a copy of the changed and modifications made by the SBCA ARC to that original permit application.
