New Business: Discussion of Village ARC common area tree/view maintenance application.
R. Kraft described the proposal put forth at the SBCA Board meeting requesting approval in principle to agree to the SBCA ARC studying the idea of giving the Village ARC more power in determining what happens in their Common Area only, and by definition accepting or denying requests in that area. He stressed that SBCA ARC still has the final approval authority. He suggested that not just the Village ARC but also the Village Board have determinacy (and maybe the Villages can determine what percentage majority is needed for approval of any application in that jurisdiction). The Village ARC must ensure that the issue is not in violation of the design standards, nor will it impact other villages views or properties. but the SBCA ARC and the SBCA Board would still have the ability and right to make the final judgment.
Al Thiede talked about topics that his Village ARC has discussed, one of which is fining, and another is the area of vegetation. asked about fines to which R.Kraft replied that the SBCA ARC is still looking at that matter and the it would appear they have the right within the CC & R’s to levy fines.
A. Andersen stated that the Master Declaration gives the Board authority to levy fines and penalties. A penalty such as re-planting would possibly be an effective deterrent. Some other discussion ensued re licensed arborists versus loggers/tree-cutters
Barbara Schaefer stated her Village ARC is investigating with insurance companies the “dangerous trees” issue and what happens when common trees fall on private property.
