Meeting called to order at 9:00 a.m.  

Minutes of October 20, 2006 meeting approved.

Homeowner’s comments regarding specific issues:

S.Hatch  informed the ARC committee that the date is not yet firm for the Bayview (Windrose) tree removal. After waiting three weeks for bid response, there was only one received – from Yeoman’s Tree Service.  T Oswald will notify ARC of the start date. It is expected the work will be completed before Christmas.

New Applications:                              06-145-Olympic Terrace-Graber-Complaint

                                    The complaint by Ms. Graber was based on tree trimming and limbing performed by her neighbor that allegedly impacted severely on her privacy.  The neighbor removed several limbs of existing native conifers without a permit from the Village ARC or the SBCA ARC and without the prior knowledge of the Graber’s.  The village ARC representative stated that they felt the complaint was without warrant and was not severe enough to adversely affect the privacy of the Graber’s.  Ms. Graber strongly disputed this.  After considerable discussion the SBCA ARC made the determination that Mr. Pendergast was in error in not submitting a request for permit to limb those trees that were over 6 inches in diameter.  The Design Standards are quite clear on this point and it was decided that a letter should be written to Mr. Pendergast admonishing him for not requesting a permit.  The letter should point out the specific paragraphs in the Design Standards pertaining to this.  Had this been done and the Graber’s been properly notified the dispute would probably not occurred.  It is difficult and expensive to remedy what has already occurred and also impossible to make an after-the-fact determination.  The Village ARC was also informed at this meeting that they should reemphasize to their members the requirement for obtaining a permit for any tree trimming of native trees over 6 inches in diameter regardless of its effect on views or privacy.  

MSP that the SBCA ARC will leave the view definition language as it exists, and consider each matter on a case by case approach.

Discussion:

Mention was made of a meeting Nov 9, 2006 held by LMC in North Bay relating to trees, views and CC &R enforcement in their area. The SBCA ARC based on its experience here in South Bay feels that its standards are very good; that there is language to protect both trees and views. For the December ARC meeting a New Business item will outline specific duties for Village ARC reps thus empowering them effectively and helping them guide their homeowners on the permit process, as well as inform them as to what actions they may approve at the Village level.

J.Perlot submitted a position paper on protecting views and rights for the committee to study.
