Regular meeting, May 13, 2005, at 3:00 p.m.
Present: Bob Force, Peggi Graham, Margi Garcia, Kees Bouterse, Pegi Graham, Greg Hupp, and Jack McKay

Mason Rothenburg submitted his resignation effective June 30, 2005.
Financial: Janet Force and Mark Garcia.
Minutes of April 2005 approved.
Financial Report:
Balance $6270.28 currently in the bank account.Check for sale of property was $5797.89. Lawyer fees involved were $516.60. Current balance from the sale of property to Jefferson County (for road project expansion) is $5281.00.
Total assets at the end of April: $103,014,41.
Landscaping Report: Compliments to Kees Bouterse on work done to improve landscaping.
Sprinkler system ready to go, backflow has been repaired.All concerns about sprinklers need to be reported to Peggi who will contact Bestscape. Sensors will be used to regulate moisture (rain). Sensors cost about $75.00 per meter.
Log of landscaping activities is now included with the invoice for March.
Bestscape has complied with the contract for the past few months.
Maintenance Report:
Partial cleaning of roofs will be done as needed.Roads: Sealing of the roads in Inner Harbor. Sealing of one-half of Chandler paid by the Bay Club. Keel needs to be done also. Bay Club will repair all pot holes. Suggestion to delay sealing to coordinate with Hidden Cove home construction and heavy truck traffic..
Cement: Pressure Washing of cement walks and driveways. Who is responsible for cleaning cement? Contact Peggi to use pressure washer.
Deck cleaning: Normal/regular maintenance is the responsibility of the home owner. Pictures shown about deck problems. Estimates range up to $10,000 for repairs of porches and stairs. Concern about sale of a unit with a deck needing repairs.
Motion to go forward on the needed repairs on Bldg 18 (stairs, railings, etc.) with an estimated cost of $8,000 to $10,000. Seconded. Passed.
Motion to repair Bldg. 16 (deck) Estimated cost of $6,000. Seconded. Passed.
CC&Rs require that homeowner maintains decks. Due to the homeowner's neglect, the homeowner will be responsible for the repair. Building inspector would determine if repair is necessary. Past practice has been that the Association be responsible for repair of decks.
The President then reviewed a letter from the IHVCA attorney, that stated that deck maintenance be the responsibility of the homeowner. Repair would be the responsibility of the Association.
Section 19.3: Assessment of cost of repair caused by willful neglect, can be assessed by the Association on the owner.
Motion that a committee of the board be formed to inspect all "limited common areas," specifically decks, stairs, porches, and driveways, patios, and walkways, to ensure that those "limited common areas" are maintained to a satisfactory level. Motion seconded. Amendment: Failure to maintain the "limited common areas" by the homeowner will result in an assessment on the property for the repair caused by the neglect. Motion passed, 3 to 2. Committee members will be appointed at the Annual Meeting.
Painting: Priority based on most severe situation. Trim painting is needed on some units.
CC&Rs Report:
CC&Rs must be reviewed so that an accurate copy is on file with Jefferson County and available to all homeowners.Motion made to form the committee with a preliminary report about the CC&Rs due at the August board meeting. Seconded. Passed. Committee members appointed are Doug Barber, Bob Force, Gregg Hupp, Bob Edelblut, and Mark Garcia.
Auditing of the books:
President Force will initiate the internal audit of the books. Report of the audit will be presented at the Annual Meeting.
Monthly Assessment:
Motion to increase quarterly dues by five percent starting the next fiscal year. Seconded. Passed.
Planning the Annual Meeting:
Special meeting by email initiated by the President. Letter to be sent by the President about the annual meeting and the agenda.Agenda:
Nominations and election of officers and directors
Audit of the books (internal and or external)
Budget report and adoption (will be discussed at the next board meeting)
Report on increase of fees by 5% starting next fiscal year

Comments from the Audience:
Mark Garcia: Salary of Fiscal Officer for next year.Trix Bouterse: Request for more information about cost of repairs of decks. Concern about who is responsible for repairs (caused by neglect) of deck additions approved previously by the Board of Directors. Petition, signed by 13 homeowners, was read about deck repair and homeowner's responsibilities.
The basic question by the Secretary: Who is responsible for the repair of decks that have deteriorated due to neglect by the homeowner? Is it the homeowner or is it the Association?Related concerns: Is the Association responsible for repairing decks that have been neglected. For example wood stacked on decks that damage wood decks, flower pots without saucers, not periodically cleaning green and black mold, and not sweeping off debris from storms.
Maryann Barber: Concern expressed about needed background information by the Board being passed on to new Board members. Need for historical background to guide new board members about past activities and decisions.
Maureen Edelblut: Request that more information be provided on major repair projects on what has been done during the past year. Suggestion that a summary of repair, maintenance, and painting projects during the past year, (e.g., building addresses, etc.)
