The South Bay Rules

Pursuant to Article 5 section 5.3 South Bay Master Declaration CC&R’s

 

General Bay Club Rules

·       All Members of the South Bay Community Association will abide by the South Bay Master Declaration, Bylaws, The South Bay Rules, Articles of Incorporation, South Bay Design Standards and all RCW’s that pertain to the South Bay Community Association

·       All persons entering the Bay Club Recreation Center are required to sign-in

·       Members’ guests are always welcome in the Bay Club.

A guest is defined as an immediate family member, or an unrelated person or individual(s) who is (are) residing overnight in the member’s home.

·       In instances where the member will be away for one week or longer and when friends or family will be staying in the member’s home the member will submit a written note to the club giving the name(s) of the (those) guest(s) for whom the member is requesting club privileges. A waiver must be filled out and deposited with the club office

·       Pets are not permitted in the Bay Club

·       No smoking is permitted anywhere in the Bay Club facility

·       Appropriate social decorum will be followed

·       Profane or abusive language or gestures will not be tolerated

·       Intoxication will not be tolerated

·       Alcoholic beverages are permitted only during scheduled events with an appropriate permit as required by Washington State law

·       Children under the age of 15 are not permitted to use the exercise equipment without the supervision of an adult

·       Only Bay Club Members can use the woodshop

·       Persons under the age of 18 can not use the woodshop

·       Any injury that occurs on the Bay Club premises should be reported immediately to a staff member on duty.

 

Dress Code

·       Bathing suits are required in aquatic activities

·       Cut-off and other street clothes combinations are not acceptable in the pool or spa

·       Shoes must be worn at all times except in the pool and spa

·       Athletic shoes and attire are required when using exercise facilities

 

Pool and Spa Rules

·       Only SBCA Members and their qualified guest can use the pool or spa

·       All users must shower using soap prior to entering the pool or spa

·       Running is not permitted in the pool/spa area

·       Food or beverages are not permitted in the pool/spa area

·       No radios or electric devices of any type are permitted in the pool/spa area without written permission from the facility Director

·       Children under the age of 16 must be accompanied by an adult

·       Diving is not permitted

·       Infants not yet “potty trained” are required to wear “swim diapers”

·       Persons with hypertension, heart conditions, or other health concerns, and those persons taking prescribed medications, should consult a physician before undertaking any strenuous physical activity, including use of the swimming pool. The manager of the Bay Club shall determine temperature settings. If you have heart or respiratory conditions, high water temperature in the spa may cause increased stress. Please check with your physician.

 

Tennis Court Rules

·       The South Bay Tennis Courts are open to all South Bay residents, guests, resort guests, and Port Ludlow Racquet Club Members.

·       The South Bay Tennis Courts are open for use year-round from dawn to dusk, weather permitting.

·       The courts are available on a first come, first serve basis.

·       Limit play to one hour when others are waiting.

·       Reserve times for groups by calling the contact person identified on the bulletin board at the courts.

·       Usage is restricted to tennis only.  No skateboards allowed. 

·       Appropriate footwear must be worn on the courts. 

·       No locks (unless problems arise)

 

Architectural Review Committee Rules

·       All SBCA Members are subject to the South Bay Community CC&R’s as well as the South Bay Design Standards rev.4 (This does not include Associate Members)

·       No improvements, alterations, repairs, excavation, grading, removal of trees with a base trunk diameter exceeding six inches(6”), or other work which in any way alters the exterior appearance of any Lot, Common Area, or Limited Common Area within South Bay, or the improvements located thereon, shall be made or performed without prior approval of the SBCA-ARC (see 2.5 South Bay Design Standards)

·       All Members must follow the SBCA ARC application process. (Please ask your Village ARC or ARC Manager at the Bay Club to help you with this process)

·       All permit letters when issued by the SBCA ARC will be signed for by the requesting members before work is to be performed. All conditions on the permit letter are to be followed.

·       Any work in Village Common and Limited Common area’s must be approved by Village Board as well as the SBCA ARC before any work is to be done.

·       Failure to comply with the SBCA ARC rules may result in a lien on your property, penalties or fines. 

Resolutions

Whereas, the Board of Directors for the South Bay Master Association is responsible under Article 5 of the Master Declaration of Covenants, Conditions, Restrictions, Assessments, Charges, Servitudes, Liens, Reservations and Easements (the “Master Declaration”) for conducting the affairs of the Master Association ; and

Whereas, under Article 5.2.13 of the Master Declaration the Board of Directors may take such actions as are reasonably necessary and convenient for the accomplishment of this obligation; and

Whereas, at its last annual meeting the Membership of the Master Association overwhelmingly approved the establishment of a system of Village Architectural Review Committees; it is

RESOLVED, that Village Architectural Committees are established as follows:

Village Architectural Review Committee. The Village Architectural Review Committee (hereafter “Village ARC”) is that group responsible for the administration of the Design Standards and Supplemental Declarations within their respective villages. Each Village’s Board of Directors shall assign the number and term for participants in the Village ARC. The Village ARC shall be responsible for the approval and oversight of those projects that fall within their defined area of responsibility.

The Village ARC members may assist homeowners in securing the proper project form, perform initial review of all projects and pass those projects that require SBCA ARC approval to that group. Those projects not requiring attention of the SBCA ARC, will be approved or disapproved at the Village ARC level which will issue the required permits.

FURTHER RESOLVED that the Director shall include this Resolution as part of the South Bay Rules available for review at the principal office of the Master Association.

ADOPTED after motion duly made and seconded on this 25th day of October, 2002 at a regular meeting of the South Bay Board of Directors.

Violations

Judgment and discretion shall be used in all instances where rules have been violated.

Violations may result in verbal or written warnings or suspension of Club privileges.

Any member or guest who does not abide by stated, posted or otherwise obvious safety related rules might be asked to leave. The staff’s judgment with respect to safety, proper decorum and sanitation will prevail in all instances. The Board of Directors shall have sole responsibility determining an appropriate penalty.
